Urway Limousine Service Terms and Conditions

Urway Limousine Service, a registered D.B.A. of Infinity Internet Marketing, Inc., or one of it’s qualified affiliates will provide your transportation services. The terms and conditions below must be agreed to prior to confirmation of your service:
1. Age - All guests must be 21 years of age or older to drink alcoholic beverages. By law, no one younger than 21 years of age can consume alcohol. If there is
any underage person (s) in the vehicle , Urway Limousine Service and/or its affiliate  will not allow any alcoholic beverages or alcoholic containers to be brought on board. For proms or children's parties, we can stock the bar with ice, water, soda or energy drinks for an extra $100.
2. Laws - All guests must abide by local laws and regulations while on board the bus. Urway Limousine Service and/or its affiliate shall not be held responsible for acts of its riders. If at any time riders' behavior is deemed offensive or illegal, they will be asked to leave the vehicle. If illegal actions by the riders cause the vehicle to be unable to provide service (i.e. leave a given area ), no refunds will be given.
3. Alcohol - It is the full and total responsibility of the group to determine the legality of transporting or consuming alcohol during the trip. Urway Limousine Service and/or its affiliate does not offer any legal advice on state and local laws pertaining to alcohol. Urway Limousine Service and/or its affiliate will strictly enforce all Municipal, State and Federal Laws and will maintain a zero tolerance compliance policy that no alcoholic beverages can be consumed or used by any person not of legal drinking age. All U.S. enforcement agencies have absolute power to stop any motor vehicle for administrative searches. If contraband is aboard (even in negligible quantities) without the driver’s knowledge, they can seize and forfeit the vehicle to a local government agency. All law enforcement agencies are aggressively enforcing this policy. Therefore, no person will bring contraband aboard vehicles that are owned or operated by Urway Limousine Service and/or its affiliate.
4. Deposits - All deposits used to hold a reservation are non-refundable . Urway Limousine Service and/or its affiliate reserves the right to apply any non-refundable deposit to a future reservation at its own discretion.
5. Cleaning Fees and Policy - There is NO smoking or food allowed on board, and there will be a minimum $250 clean-up fee if evidence of smoking or food is found in the vehicle. All cleaning fees and charges are at the sole discretion of Urway Limousine Service and/or its affiliate.
6. Vomit Fee - There is a minimum $250 clean-up fee if anyone vomits in the vehicle. The fee will be charged to the person that agrees to these terms and conditions and who’s credit card was used to reserve the vehicle. There are no exceptions to this rule.
7. Delays - Urway Limousine Service and/or its affiliate shall not be held responsible for late pickup or arrival during the rental caused by, but not limited to, acts of nature , traffic delays, vehicle breakdown, incorrect pickup and/or drop-off information, GPS directions, or any situation beyond its control.
8. Customer Losses - Urway Limousine Service and/or its affiliate shall not be held responsible for any losses to customers as a result of its services. We are not responsible for event delays or costs incurred by the customer, such as tickets , table reservations , or any other arrangements that may be involved during the trip. Urway Limousine Service and/or its affiliate cannot be responsible for any loss due to inconvenience, costs, indirect, consequential or contingent damages resulting from the use of its services. Urway Limousine Service and/or its affiliate cannot be responsible for losses due to weather conditions, natural disasters, acts of God, war, unpredictable vehicle defects, or any acts of terrorism.
9. Directions - It is the sole responsibility of the customers to provide address and contact information for the destinations they will be visiting during their trip. Urway Limousine Service and/or its affiliate is NOT responsible for GPS route selection, delays due to locating a venue, or ANY other logistical issue involving directions.
10. Partner Bars/Clubs - At ANY time and for ANY reason, a bar/club/restaurant or any other type of establishment may deny entrance to a group at its venue. This may include, but is not limited to, group appearance, behavior and level of intoxication. Urway Limousine Service and/or its affiliate is not responsible for the acts of these establishments.
11. Minors - If the bus is rented by a person younger than 18 years of age, then the agreement must be signed by either a parent or legal guardian older than 18 years of age.
12. Rider Behavior - No drugs, violence , weapons, verbal threats, or intimidation of staff will be tolerated . Urway Limousine Service and/or its affiliate has a zero-tolerance policy for disorderly behavior and the ENTIRE PARTY will be immediately dropped off at their prearranged destination and no refunds will be given for unused time , The unruly person(s) in question will be asked to get off the bus at the next available public gas station , parking lot , shopping area or location where it is safe to de-board.
13. Driver interaction - Do not under any circumstances distract the driver. We want you and your party to arrive safely.
14. Customer Property - Urway Limousine Service and/or its affiliate is not responsible for any lost, damaged, or stolen property . Please keep all personal items with you at all times.
15. Urway Limousine Service and/or its affiliate - If any property of Urway Limousine Service and/or its affiliate is damaged or stolen by the contract holder or guests, they will be held liable for replacement costs, collection fees, attorney fees, court costs, etc.
16. Events outside the vehicle - We are not responsible for what happens while passengers are out of the vehicle. For example, at no time do we allow alcohol in the vehicle if there is anyone younger than 21, but we cannot stop or be responsible for what guests do while they are away from the vehicle.
17. Time and Billing - Please note that your party begins at your scheduled time for the initial pick-up and ends when the bus leaves the last drop -off address at the end of the rental. No exceptions. Any overtime will be billed at the contracted rate and customers agree to pay any overtime charges. A 10-minute grace period is allowed, and you will be billed in 30-minute increments after that 10-minute period. Additional charges will be billed to the credit card on file. Please note there is no guarantee that overtime hours will be available, so be sure that you book the vehicle for a sufficient number of hours. The driver has no ability to waive time overages!
18. Safety - If standing or dancing while the vehicle is in motion, please keep one hand on a rail for your safety. If on a party bus, Do NOT hang or swing on the provided hand rails as they are not intended or designed to support that amount of weight. At no time will we allow anyone to hang out the windows ( heads, arms , hands, body) or throw trash out the windows. This is for your own safety. If you do not abide by these rules, we will end the party.
19. Vehicle Substitution - Customer agrees that a replacement bus may be substituted in the event of any major mechanical issues or accidents, etc. If this occurs, we will try to notify you in advance.
20. Payment Methods – Payment terms will be agreed to in advance between Urway Limousine Service and the party providing their credit card to reserve the vehicle. The payment terms will be noted in a confirmation email and might involve final payment be made directly to a Urway Limousine affiliate. Final payment is the responsibility of the person who’s name is on the credit card used to reserve the vehicle and might include additional charges incurred according to these terms.
21. Cancellations - If you cancel your reservation after it has been confirmed, then you will surrender your deposit amount, Saturday rentals have no cancellation policy and will be charged the full fare if cancelled. Cancellation must be in writing (CERITIFED MAIL) within 14 days of your scheduled event to avoid being billed the full amount. This means you will pay for all charges. By agreeing to these terms and conditions, you are authorizing Urway Limousine Service and/or its affiliate to charge the credit card for any of the following: deposit, cancellation fee, NSF fees, damages to the vehicle, and all services rendered. Time changes are subject to availability. If you do not take your scheduled trip because your time change cannot be accommodated, you will be charged the full amount.
22. Weather - Trips cancelled by the customer due to weather conditions are subject to the same cancellation polices outlined above. Any trip cancelled by Urway Limousine Service and/or its affiliate management will be given an opportunity to reschedule; however, if another date is not suitable. then the deposit amount will be forfeited.
23. Risk - Enter at your own risk. Our primary focus is safety. All modes of transportation, including bus transport, involve an inherent risk of injury or property damage. By agreeing to these terms and conditions, you and your entire party voluntarily accept and assume all risks of injury, loss of property or property damage that may result from this trip.
24. Jurisdiction and Venue - Customers consent to jurisdiction and venue in all actions resulting from this agreement where they are located. Client consents to pay all attorneys' fees incurred to collect payment or resolve disputes, and these fees may be in excess of $2,500.
25. Hold Harmless - As a condition of being permitted in the vehicle and the use of this charter, the contract holder and its ENTIRE PARTY, AGREES TO HOLD HARMLESS, RELEASE, INDEMNIFY, AND PROMISE NOT TO BRING A CLAIM AGAINST OR SUE Urway Limousine Service and/or its affiliate, its parent company owners, sister companies , employees, agents, officers or affiliates from any and all liabilities on account of, in any way NEGLIGENCE or by any other reason. I understand that this is a legal and binding contract. I agree that this contract shall be governed by the laws of the state where the service is provided. I understand and agree that this agreement is intended to be as broad and inclusive as possible as permitted by law, and if any portion is held invalid, the balance shall continue in full legal force and effect.
26. Acceptance of Terms - Entry into a vehicle constitutes acceptance of these terms.
27. Non-Performance - If Urway Limousines is unable to perform the services as contracted due to an unforeseen reason, we reserve the right to cancel the reservation and issue a full refund to the customer.
